電 視牌照未解決  公道何在?


電 視發牌風波並沒有因為特首、局長、行會成員各自解釋而消減分毫,反而令問題更清晰,就是政府何以未經諮詢便改變過往一直對外宣稱的無上限發牌政策而決定三 選二,將香港電視踢出局,擅改政策,政府掛在口邊的『程序公義』只是按照程序『搬龍門』!有很多IT界朋友十分關注事態發展,向我反映發牌結果不但令傳媒 和廣播機構的編輯和創意自由蒙受陰影,亦悖逆香港一直奉行的制度理性和公平原則,重大打擊IT相關的創意媒體行業,影響IT和創意工業的營商及就業前景。


我 今日連同八位議員聯署在內務委員會提出討論在10月30日會議上引用《立法會權力及特權條例》動議議案,要求有關當局向資訊科技及廣播事務委員會提供所有 相關文件。遺憾地,議案不獲通過,但這亦是預料之內。我已獲立法會主席批准在11月6日的立法會會議上再次動議引用特權法向政府索取相關文件,請建制派同 事三思,不要再次違背民意。


雖然電視發牌事件未平,但其他工作仍需繼續。版權條例處理戲仿和二次創作的諮詢期延長至11月15日,立法會將工商事務委員會於11月4日舉行公聽會聽取團體意見。早前有網民團體提出參照加拿大模式的『第四方案』,但是否可行尚未有詳細討論。香港互聯網協會將於10月31日晚上舉辦『戲仿豁免何去何從』研討會,邀請到多位講者包括政府代表、版權界、網民代表和創作者對談,歡迎大家出席提出意見!

商務及經濟發展局現正進行「2014數碼21資訊科技策略」 公眾諮詢。諮詢文件中提出「智慧香港,智優生活」策略,並以幾個綱領,期望使香港透過科技推動經濟持續發展、建立分享及協作平台、向公眾提供貼心易用和整合的電子服務,以及促進資訊及通訊科技業的發展。誠邀大家參與IT Voice 2012主辦,11月9日上午舉行的2014數碼21資訊科技策略研討會,了解諮詢文件內容,發表意見及提出建議,讓我們反映業界意見。(按此登記)

Dear IT friends,

TV License Fiasco: All We Want is Justice

The controversies over free-to-air TV licences continue to brew. Despite attempted ‘explanation’ by the CE, Exco members and the Secretary for Commerce and Economic Development (SCED), all they achieved was no more than making the problem clear: that the adminisration, without due consultaion, has deviated from its own policy of allowing unlimited licences, opting to issue only two new licences, and ousted HKTV with no explanation. This blatant neglect of existing policies is unacceptable. The government’s so-called ‘procedural justice’ merely means they moved the goal-posts with due procedures! Many of you voiced your grave concerns over the freedom of media and broadcast organisations, corroding principles of procedural rationality and fairness, and the impact towards IT-related opportunities and business prospect in creative industries.


This is why myself and 8 members proposed at the House Committee today to discuss invoking the powers under the P&P Ordinance to demand the SCED to present all relevant documents on or before the ITBP special meeting on 8 Nov. The motion did not pass, regretably. I will move the same P&P motion again in the Council meeting on 6 Nov. I urge my colleagues to carefully consider and not go against our citizens’ clear demand.


While the TV fiasco drags on, other work continues. The consultation period for parody under Copyright Ordinance is extended to 15 Nov and the Panel on Commerce and Industry will hold a public hearing on 4 Nov to listen to stakeholders. Some netizens have advocated the adoption of ‘Non-commercial User Generated Content’ as option 4, in reference to Canada’s legislaion, yet there has not been much discussion. Internet Society Hong Kong will organise a forum regarding parody on 31 October evening (Cantonese only event), putting together a strong line-up of speakers from the government, copyright industry, netizens and content creators. As mentioned earlier, the CEDB is conducting a consultation for its ‘2014 Digital 21 Strategy’. It sets out the “Smarter Hong Kong, Smarter Living” Strategy with a framework for Hong Kong to leverage on new technologies to sustain economic growth, build platforms for sharing and collaboration, deliver intuitive and integrated e-services to the public and foster a thriving ICT industry. IT Voice 2012 will organise a forum on Digital 21 Strategy on 9 Nov morning, come and learn more about the proposed strategy and voice your suggestions so we can reflect your views to the government. Finally, friends interested in developing business in the mainland should pay attention. HKISPA launched its BUD fund project “Synergising Hong Kong ICT Hub with the Mainland Businesses” last June, aiming to brand Hong Kong ICT, particularly data center related services, to the Mainland businesses that Hong Kong has one of the world’s most advanced network infrastructure and rule of laws that can help their businesses to continue thriving and reaching out to the international communities. In the coming 2 years, there will be 7 expos and 14 seminars.
